Voting Questions For the Big Canoe POA + a $269 Property Owner Challenge!

As part of the 2016 Developer Bailout Land Investigation, I have begun compiling a list of historical changes made to the Big Canoe Declarations and Covenants.  As I began looking through and reading some of these documents, I gained a much greater understanding of how Voting Rights work in Big Canoe.

Here are just a few interesting questions that I think residents deserve the answers to:

  1. How many Votes did the Developer lose when Potts Mountain was put into Conservation Easement?

  2. How many Votes did the Developer lose from the 2016 Sale of land in “Mother Canoe” to the POA?
    .
  3. How many Votes did the POA gain from the 2016 Land Sale?
    Note:  Most people are aware of Class “A”, “B”, “C”, and “D” voting shares, but have you ever heard of Class “E” voting shares?  If not you should read the 2001 Covenants :: Page 2.  It raises some interesting questions about who really controls the Big Canoe Vote.

  4. What would be the TOTAL number of eligible Votes if a vote were to be held today?  It seems like that would be an easy answer, quickly available.

  5. As directly relates to an answer given for #4, above, how many Votes would there currently be for each of these “A”, “B”, “C”, “D”, and “E” Vote Classes?
    • How many “A” Votes?
    • How many “B” Votes?
    • How many “C” votes?
    • How many Class “D” Votes?  (important)
    • How many Class “E” votes are there?  (important)
      In regards to “E” votes, how many are held by the POA?  How many are held by the Developer (“Company”)?  What land relates to what Class “E” voting rights?    (important)

  6. Are their different rules for different kinds of Votes?  i.e. Board Positions; Covenant Changes?

I am posing these voting questions to the Board.  As with inquiries from others I have heard of over the years, I expect they will not provide any answers.  If they do, I will update the information here.

I also have a challenge for any Property owner of Big Canoe.  If you can get the Board to answer ALL of the above questions in a verifiable manner, then I will pay you $269 (that’s+/-  a one month POA Home+Lot fee).  That’s right, $269 to the first property owner who can send me an email forward, or a facebook screenshot, or a scan of a letter, or any other proof, coming directly from a POA Board member acting in his formal capacity, that answers all of the above very, very simple questions.  Answers must be exact and provable, because we are talking about exact numbers, which at the time of all earlier votes they have been able to calculate down to the individual vote count (i.e. the 2005 Amended Covenants states “The total number of votes of Members of the Association was 9775), so somewhere they have this information available at their finger tips…. they just refuse to share it.  Deadline of Oct 15, 2018 for the contest.

We are not seeking nuclear launch codes…. just a breakdown of how voting works in the community.  Doesn’t that sound like rather reasonable information a property owner could expect to be entitled to?

Fortunately, or unfortunately, I think my money is pretty safe in my pocket for two reasons.

  1. The POA Board has no intention of providing this information.
  2. The Property Owners of Big Canoe have a long history of not asking questions, and will most likely follow tradition of taking “No” for an answer.  I doubt even $269 dollars could get them to demand an actual answer.
