NUMEROUS ALLEGATIONS OF IMPROPRIETY SPUR RECORDS REQUEST

“Please find attached a 7 Page PDF Request to Review and Copy Records, made pursuant to Big Canoe Policies and Related Procedures; Procedure 156.2 (POA Member Access to Records)……..”

The Records Request contains a 4 page background of the situation, along with an itemized list of general concerns and allegations that are the rational for the request. It should be noted that at the time of this post, the POA is already past the allotted time (5 business days) for them to respond, as outlined in the Board Policies ad Procedures.
 
They have refused to provide the Records, and have “lawyered up”. Any Big Canoe Property Owner reading the allegations listed as basis of my request to review the records will quickly understand the serious nature of the situation.
 
Many people in the Community have over the years attempted unsuccessfully to obtain openness regarding this $9,400,000.00 Land Deal. At least one well known resident, an attorney, has contacted the GM to encourage compliance, stating his concern that “if Mr. Hopkins demands are not met, the Board and any other officers or employees involved in such failure to produce requested documents will put themselves in jeopardy of substantial financial liability. Liability that even Directors E&O won’t cover.”
 
None of this has moved the Board. They obviously feel that whatever they are hiding is important enough to fight to keep secret. The facts uncovered so far….. lead ME to believe that whatever it is they are hiding….. is important enough to fight to bring into the light.
 

At this time attorney consultations are being scheduled in order to compel release of the Records Requested.

UPDATE Tuesday, August 28 2018: The Big Canoe POA Attorney, George Nowack has just formally responded and denied the Request for Records on behalf of the POA Board. The paraphrased gist of the comments are “If you want the records, file a lawsuit.” and contained several reasons why the Property Owners of Big Canoe were not entitled to see any of the documents related to the land sale.
